These General Terms and Conditions of Sale govern sales concluded between:
The lucky charm,
and any natural person acting in their capacity as a consumer, hereinafter the “Client”.
These T&Cs apply to orders placed on the website www.oceaumarine.fr or www.oceaumarine.com
1. Subject
These General Terms and Conditions define the conditions under which the Customer may order the products marketed under the brand Ocean Marine on the site.
2. Products
The products offered for sale are those shown on the website on the day of consultation by the Customer, within the limits of available stock.
Photographs, visuals, descriptions and instructions for use are provided for guidance only. Despite every care taken in their presentation, slight non-essential differences may exist.
The products marketed are notably cosmetic products and, where applicable, other products distributed by OCEAU MARINE.
3. Price
The prices are shown in Euros, all taxes included (TTC), excluding delivery charges unless otherwise stated.
The delivery charges applicable to the order are shown before its final validation.
OCEAU MARINE reserves the right to modify its prices at any time. However, products will be invoiced at the rate in effect at the time the order is confirmed.
4. Order
The customer selects the products they wish to purchase and adds them to their basket.
Before final confirmation, the Customer can check the details of their order, the total price, correct any errors and familiarise themselves with these Terms and Conditions.
The order becomes final after:
- Basket validation,
- express acceptance of these T&Cs,
- and confirmation of payment.
A confirmation email is sent to the Customer.
5. Availability
Offers are valid while stocks last.
In the event of a product becoming unavailable after order confirmation, the Customer will be informed as soon as possible and may obtain a refund of the corresponding amount.
6. Customer account
Creating an account may be necessary to access certain site features or to place an order.
The Client undertakes to provide accurate, complete, and up-to-date information. They are solely responsible for the confidentiality of their login details and the use of their account.
7. Payment
The accepted payment methods are those offered on the website at the time of purchase.
The price is payable in full at the time of order confirmation.
OCEAU MARINE reserves the right to suspend or refuse any order in the event of non-payment, payment default or suspected fraud.
8. Delivery
The products are delivered to the address indicated by the Customer when ordering.
Delivery methods, estimated timescales, and applicable charges are shown before you confirm your order.
Unless otherwise stated, OCEAU MARINE delivers to mainland France and to areas expressly offered on the website.
If no specific deadline is indicated, the professional must deliver without undue delay and no later than 30 days after the conclusion of the contract.
The Customer is responsible for checking the accuracy of their contact details. OCEAU MARINE cannot be held liable for any errors in entry attributable to the Customer.
9. Right of withdrawal
The Customer has a right of withdrawal of 14 days from the receipt of the products, under the conditions detailed in the Refund and Returns Policy.
10. Legal Guarantees
The products sold benefit from the Legal guarantee of conformity and of the legal guarantee against hidden defects. The consumer can take action under the legal guarantee of conformity within a period of two years from the delivery of the goods. In the event of a lack of conformity, the bringing into conformity shall be carried out free of charge for the consumer, under the conditions provided for by the Consumer Code.
The Customer benefits from the legal guarantee of conformity provided for in Articles L217-3 to L217-20 of the Consumer Code, along with the warranty against hidden defects provided for in articles 1641 to 1649 of the Civil Code.
11. Exclusions and clarifications on products
The warranty does not cover, among other things:
- use not in accordance with the instructions for use,
- deterioration due to poor storage,
- abnormal uses,
- product modifications,
- Use beyond the recommended use-by date.
OCEAU MARINE's products are cosmetics. They are not medicines and cannot replace medical advice, treatment, or healthcare.
12. Responsibility
OCEAN MARINE shall only be liable for direct damages resulting from a proven breach attributable to it.
Its responsibility cannot be engaged in the event of:
- non-conform use of products,
- the Client's fault,
- in fact unpredictable and insurmountable by a third party,
- or force majeure.
13. Personal Data
personal data collected in connection with orders and customer relations are processed in accordance with the Privacy policy from the site.
The Customer has, under the applicable legal conditions, rights of access, rectification, erasure, objection, limitation and, where applicable, portability.
Under GDPR, it is no longer relevant to state an old “CNIL declaration number” as in old templates; it is most important to clearly inform about the processing activities, their purposes, and individuals' rights.
14. Cookies
The site may use cookies and other trackers. Cookies that are strictly necessary for the site's operation may be placed without prior consent. However, other cookies, particularly certain advertising or audience measurement cookies that are not exempt, require clear information and prior consent.
15. Intellectual Property
The entire content of the site (texts, visuals, logos, brands, photos, videos, graphic elements, structure, databases, etc.) is protected by intellectual property rights.
Any reproduction, representation, adaptation, exploitation or use, in whole or in part, without prior written authorisation, is prohibited.

17. Consumer mediation
In the event of an unresolved dispute after a prior written complaint to our customer service department, the Customer may refer the matter, free of charge, to a consumer mediator.

18. Applicable Law and Jurisdiction
These General Terms and Conditions are governed by French law.
In the event of a dispute, and failing an amicable resolution, the Customer may refer the matter to the competent court under the conditions laid down by consumer law.
19. Partial nullity
If any provision of these T&Cs is declared void or unenforceable, the remaining stipulations shall remain in force.
